Visitation For Shaniya Davis Draws People From Community

A line of people formed quickly outside Rogers and Breece Funeral Home in Fayetteville Saturday evening, as the visitation was held for five-year-old Shaniya Davis.

Many of mourners who came never knew Shaniya, but said they were deeply impacted after hearing what happened to her.

"I could just only imagine what (her family) are going through," said Kay Fuller. "I mean it's touched a lot of people because it's just something that's unbelievable."

Davis's body was found Monday after the girl went missing from her home at the Sleepy Hollow Mobile Home Park almost a week before.

Her funeral service will be held Sunday at Manna Church in Fayetteville at 3 p.m.

An arrest warrant released Friday revealed Davis was raped and killed the same day she was taken from her home.

Meanhwile, Mario McNeill, the man who police said admitted kidnapping her, appeared in court Friday on first-degree murder and first-degree rape charges.

Inside court McNeill had nothing to say and Shaniya grandmother, Ann Summers, never had the chance to ask him one question.

"I wanted to see him and ask him why did he take my granddaughter away," Summers said.

McNeill was transferred to Central Prison in Raleigh on Friday from the Cumberland County Detention Center. His next court date is scheduled for Dec. 9.

According to the State Medical Examiner's office, Davis was murdered. The preliminary test results show asphyxiation as the cause of death, but police said all examinations and testing have not been completed therefore a final report has not been issued.

Shaniya Davis' mother, Antoinette Nicole Davis, has been charged with human trafficking, felony child abuse/prostitution, filing a false police report, and resist, delay, or obstruct. 

Summers said despite the charges her daughter is facing, she said Antoinette was not involved in drugs or prostitution and did not sell Shaniya.

"She took great care of her children, she would not harm her children she would not hurt her children," Summers said.

Davis is being held in the Cumberland County Detention Center.

According to warrants, McNeill admitted taking Davis. Police say he was with her the last time the 5-year-old girl was seen alive.

McNeill's girlfriend April Autry said "it's tough" and she's "hanging in there." She said the two share a child and have another on the way.

Marcus Haire said the couple was living in one of the vacant homes he owns on a Fayetteville street. He said McNeill burned down another of his homes in the past but it's hard to believe what he is accused of now.

"It's a sad thing, it doesn't seem like something he would do," Haire said.

Davis reported missing from her mobile home park around 7 a.m. on Nov. 10. Searchers found her body Monday off Walker Road, about six miles from the hotel where she was last seen alive. The official cause of Davis' death is still undetermined.

Antoinette Nicole Davis could face more than 30 years in prison on her charges. Police have not given any further details about the human trafficking and child abuse/prostitution charges

Police search warrants of McNeill's car, a 1997 Mitsubishi Galant, indicate that police found a black and yellow girl's jacket and a child's pair of  jeans. Police also took a plastic straw, swabbings and soil samples.

It is unknown at this time what McNeill's connection is to the child, police say. April Autry tells NBC17 that she is McNeill's girlfriend and is friends with Shaniya's aunt.

McNeill was put on unsupervised probation just weeks before Davis went missing. McNeill has been charged multiple times since 2001. The charges include assault inflicting serious bodily injury, possession with intent to sell marijuana and cocaine and with maintaining a vehicle for drug use and hitting a police officer with his car.

The Department of Correction said a judge granted McNeill's request to be released early from probation.

McNeill's attorney, Allen Rogers, said those types of decisions are normal if the person in question has been doing well.

"What's important is he fulfilled all of his responsibilities, all that was required of him and was terminated," Rogers said. "That's the standard. The judicial system did its part."

Previous suspect Clarence D. Coe was released from jail and charges against him have been dropped.

    OK, now let's talk about Social Services and the child's Grandmother. First, we all know that Antoinette's Mom is going to say whatever she can to take up for her daughter. How dare her say her daughter(Antoinette) is innocent when Antoinette allowed HER Granddaughter to be taken for sexual servitude in exchange for a drug debt!!! Antoinette's Mom is going to keep on talking and soon she will be our topic of conversation. And what about Social Services? Where were they? They allowed the little girl to stay with her Mom! They should also be persecuted! Why this woman? And her house is condemned! Drugs, prostitution and the whole nine yards but yet Social Services evidentally dismissed all of that. WHY? Anyone else and Social Services would have had the kids removed. What about the rest of the kids? What about all of the children who are being hurt and shamed that we don't know about? There needs to be a law whereas any Mother who does drugs and that allow her children live in filth be put behind bars. Go raid the homes and pull the kids out.

    Well, through researching the Dad and the aunt C, I have come across interesting information. I would like to know if TY and Aunt C are related by marriage. This entire family is intertwined so much. Then, Mario's brother is quite acquainted with Shaniya's Dad's other children. I have no doubt that the negligent Dad knows McNeill. Dad is trying to shut everyone up. Why? Also, I wish his job would be researched because I do not think he has been working at all. His out of town trips are to where other family has been living - not work. I want the slimy murderer MN to die for what he did to Shaniya. I want her so called mom to go to prison for life. Then I would like to see Shaniya's Dad and Aunt C to be charged with negligence. They fed Shaniya to the wolves and still yet cannot keep their stories straight. If it comes out that Aunt C. withdrew Shaniya from school, will you be able to connect the dots? Also, the Dad has his home mortgaged to the hilt. Now he wants donations for Shaniya's funeral. Ironic. Sell the BMW, moron, and if there is any money left over, go to CVS and buy some condoms! At least in death, Shaniya will have the dignity no one let her have in life. And also - surely the Dad does not have custody of Shaniya's body because he is not on paper anywhere as being legitimate. The slimy mother is in jail - so who has the right to the funeral decisions? I hope there is no big, fake, emotional outburst at the funeral from Daddy Dearest as was at the vigil where he even spoke in black slang. Geez.......................

    repost! i dont think that either one should be allowed to live... yes contact your politicians, to ensure they are never on the streets again! i think prison is too good for them...they should be stonned or hung in the middle of town! there is way to much child rape and prison is not stopping it! i know that i dont want to spend the $50,000 (or more) to support these type of people in prison. Where all to often they do get out just to do it again! I dont want to pay for their clothing, food, shelter, medical, education and rehab.. i would much rather spend it on some deserving family!!

    I Hope that EVERYONE who wants to see justice done for this horrible crime contacts the governor, the senators and the state reps in North Carolina and demand that there be a FULL investigation into what happened here, It is very easy to blow off steam here in this commentary page but DO take action, It’s very easy to contact these people and express your outrage and demand that justice be served and that there be a laws passed to make crimes like this to not go unpunished to the fullest extent of the law. I personally think that there should be a Law passed in Shaniya's name so that this will not be forgotten and that ALL of our children be given the benefit of being protected from this and that the social workers involved in these cases will remove children from situations like this and place them in homes that Will be safe, clean and secure. It is a disgrace that the people who say that they loved this little girl would talk about how they worked so very hard to give their children a safe and secure place to live they throw their children away like they are plastic and not give them the respect that they deserve and the safe havens that we owe them because we chose to bring them to life. Don’t let these words we are writing here stay here, Call the People who CAN influence the outcome of this case and do not be fooled by the show that these people are creating in order to hide their own neglect, gross negligence and their false reports and statements that are opposite of what they truly did to put this little angel into that situation. No one, no one at all, who is involved in this crime is without shame and the people around them KNOW that they putting on a show. I Applaud those who have come forward and told the truth about who the father and aunt.     Ok this case still makes no sense. I live close to Fayetteville and Sanford and as I try to figure this out its not making any sense. Question 1---if McNeil was going to rape and kill Shaniya would he take her to the Comfort Inn where you have to go through the lobby to get to your room. Who was the room registered to? Would McNeil pay $100 for a hour with Shaniya if the mother owed him money why spend more money? There are motels in Sanford for $50 that you get a key and the rooms are made where you walk right in them without going through the lobby. Why be seen with your murder victim and spend a $100 if somebody owed you money. THE mother's 911 call makes no sense---she told the truth in the begining when she said 5:30 the night before. Thats when McNeil really picked the girl up and he was suppose to have her back by a certain time. The noise the neighbor heard was Antionette trying to stage a crime scene and she wanted someone to hear noise so it would seem like she Shaniya was kidnapped. If Clarence Coe said he lived there a whole month but he didn't stay that night I wonder why? I know he said he had to babysit but why this particular night if he was there every night for a month. I don't believe he had anything to do with it but was this the first night he babysitted. I don't know if my boyfriend would leave me for a whole night to babysit somebody child. If it was a safe enviroment then the child would have came to stay with us. So what's up with that. Did Clarence Coe know anything and he didn't want to get involved? The father---I'm a mother and there's no way I would kiss on my children the way this man continued to kiss on his son on Nancy Grace. Did you see how he held on to his son from behind, massage him and then I once saw him whisper something to the boy and tried to pretend he was kissing him on the back. He is a child molestor and I know it. I'm a survivor of child molestation and rape and I saw the boys eyes when the father was doing these things.--The brother and sister shows no emotions about the death of Shaniya and I believe they know its the only way Shaniya would be safe. Those kids have been through something and it's more to this father than we all think. He may have yall fooled but not me. Shaniya you are in the safest place for you.......GOD will protect you and keep you now......We love you!

    Well in response to my last post, its good to agree to disagree but my issue is that in serving justice it has to be dealt with and all of the things that lead up to the event are relavent and all of those who contributed are responsible and should have to pay for their hand in this horrable tragidy. This will perhaps teach those who were a party to the deed that they are responsible too. how many more children is this man going to throw away? so far its 6, only shaniya had to pay with her life, the others were old enough to find shelter or know they were in danger. Shaniya was not. I am heartsick for this baby and as i believe we all are over this, I hope that her life was not lost in vein and for those who look for the attention or publicity at that babies expence i hope that you are exposed for the frauds that you really are and are put in jail right along with those that you enabled to take this poor babies life.

I think they would but yet they are so willing to permit murders and rapist go free if they think their time is up. Both of those low life bitches should be tortured slowly. I would suggest putting them both in tar for starters. Take them out and savagely rape both of them, let'em beg for a while and put'em back. Let justice be done this time North Carolina!! The mother who is pregnant again, should have the baby taken away from her the moment the baby is born and forced to have a complete hysterectomy!     Mario and Antionette should not have protection while in prison. They should be raped and passed to inmates. Let them be sold for cigarettes. I feel that an injection is an easy way for them to die. I'm hearing that the mother could face 30yrs for what she has done.This is a disgrace, the woman will still be young if she gets this sentence once she's out. The death penalty should be more brutal than an injection.Now, I hear that the father will have time to talk with Oprah tomorrow. There is something about this man that is not sitting right with me. He is doing alot of media outlets for a grieving father.

    Since North Carolina is so lenient with criminals, I doubt Shaniya's mom, the kidnapper or anyone else involved in the case will do any real time. My solution to the problem is to kill both of them by way of the gas chamber. Why should they ever have a trial? Did Shaniya have a trial? Did not Shaniya want to live? It is my wish and my hope that both of those evil, wicked, low down & dirty bastards die soon and slow. We demand justice for Shaniya!!!! Oh yeah, The world is watching you North Carolina!!

    Where is NC Attorney General ROY T. COOPER? Why is he so silent? His claims to protect children from predators through his programs and projects apparently are NOT working. WHY did the reports of child abuse deaths disappear? Why is it so difficult to find an annual report of CHILDREN KILLED DURING CHILD ABUSE? You don't protect children by hiding the problem. In MEMORY OF SHANIYA DAVIS, ask NC AG Roy T. Cooper to step up to the plate and admit he has failed our children and get to work on some solutions, like ..uhm.. having some mandatory jail time for sex offenders instead of letting them "plead down" and get probation. He could call it SHANIYA'S LAW. You can rant and rave all you want - but we need action to protect the children. Make it easier to report anonymously child abuse. Do something besides using the child's torturous death for media ratings and image making.

Who are this men and wicked women? what are they? from what rock did they crawl out of, and why have we as a counrty become so complacent? When will it end? the fear for our children and their lives.     I had this thing figured out from the get go and it doesn't take a stupid person to figure it out. Mom is a drug addict and she needs money to buy drugs. She knew she had a beautiful daughter that she knew MEN would just love. So, she figures that if she could convince the Father of the the little girl that she had changed her life around and get the girl back then she could make some money to buy her bootie. A LOT OF $$$. She was also told that she might not see her daughter again if she ever let her go. So, now, everyone involved gets scared that the little girl might talk to someone and they don't want to get caught. So, what do they do? They kill her and get rid of her and they think that no one will find her in the thick cudsu. The rest is history. It doesn't take an idiot to figure this one out. It has happened too often and science will find you no matter how hard you try to get away with it. And you WILL be put to death! So let the law do their job and execute the perpetrators! PLUS...it's too bad that the law doesn't punish the perpetrators in the same way that the victim died. Now..that would be justice! I also hope that the rest of the similar cases that haven't made National television come to justice too!!!

    I too am offended about the people claiming she had burn marks and blaming the father. If these people knew that she was being abused with the cigarette burns then why would they just now come out and say it versus actually going to child protective services and reporting it? Makes no sense to me. The father in-law, friend and daughter should be mad at themselves because they did not do the right thing. Not place the blame on the father.

    I am a father of two girls and lost my son when he was only 5 months old to SIDS and if anything ever happened to another one of me kids I don't know what I would do. I was just listening to what the father in law was saying and I am deeply offended that he has gall to blame the father and the mother and boyfried carried out these horrible acts. My heart goes out to the family but they need to come together becuase they have all lost someone special and stop blaming the wrong person.

Let us not forget Shaniya by getting involved and keeping her death in the face of the NC Atty Gen; the NCGenAssembly, the Governor, and our federal representatives. Let us ask for a SHANIYA Bill to put these perverts who buy children and those who sell them into sex servitude in prison for life - no parole. In Shaniya's memory, let us not forget that the sex trafficking of children in NC and the USA is pandemic; goes hand in hand with child pornography. REMEMBER SHANIYA DAVIS and take some kind of action in her memory.

Anytime there is a felony and a death occurs it is felony murder. Kind of like being the get away driver at the bank your friends just held up but things went wrong and someone was killed, you are just as responsible as the person that pulled the trigger.

    I am very angry with Social Services, the mother and all those involved with this precious child's tragic death. The mother is a drug addict and probably a prostitute herself. This beautiful child died because of a dyfunctional system. No one stood up for Shaniya's rights or her life. Why was Shaniya with her mother when she (the mother)is clearly not competent to be called a mother? Where was Child Protective Services, where were the neighbors? The only way these types of crimes against "OUR" children will stop is if "WE" as a community come together and look after one another and most importantly "PRAY". Shaniya's mother is a drug addict. Shaniya's grandmother and other family members are defending "the mother". That is part of the problem, denial. The mother is guilty of prostituting her own child and probably an accomplice to her death. "ALL" those involved should either spend the rest of their pathetic lives in prison or be executed!

    QUESTION: Why didn't the hotel call 911 and get the SANFORD police to respond (or sheriff)? Why did the Fayetteville police respond and does the Fayetteville police have jurisdiction in Sanford? Notably, the Fayetteville Observer front page had a BIG photo of the mother and just a tiny image of Shaniya. Where is NC Atty General Roy T. Cooper? Why is he so absent. She had obviously been crying and surely was scared to death of breaking down on camera.     Read some comments and BOY some of you guys do NOT listen to the news at all. That baby was spotted at 4am to 4:30am in the hotel it was around 5:30 to 6am when police arrived and they had already left. No ONE checks into a hotel with a half NAKED 5 year old unless they are up to NO GOOD (god i hope DNA was not compromised) we will also find out that the child has already been molested my guess is at the hotel. I am figuring that who ever was going to buy her backed out and their only coarse of action in their mind was to elliminate her. What a waste of a precious and lovely little girl. But in my opinion the video at the hotel speeks VOLUMES she's half dressed, hair is just in shambles she can't WALK what is that telling you people???Either way they had 48 hours she was dead soon before or right after.

    angela, I totally agree with you. Unfortunately, in NC too many child sex offenders get to plead down and only get "probation". I hear NC AG Roy Cooper say the opposite a lot, but in reality the plea deals with no prison time seems to be the "rule" not the exception. Recently, white well known upscale business men charged with child sex offenses get positive press and a boost from the media.

    Pamela Waldher came to live with her dad in Fayetteville. She disappeared and he never once got on TV asking for help to find his child. He refused to talk to the police. Her body was found around 2 years after she disappeared. Dad still kept silent and off the air even when they found her remains. The grandparents came from Washingon State to ask for help, they paid to put up billboards. -- Now Shaniya Davis comes to live with her mother in Fayetteville and disappears, and Mom never gets on TV to ask for help to find her child. I guess as reported earlier this year, Fayetteville NC is the 3rd worst town to raise a family in.

I also hope that the FBI, and Fayetteville P.D. make sure to press charges against this "mother" for not protecting someone so young -children trust their parents to do the right thing.     Lets compare: in the Fayetteville Observer you can get a $50,000 bail for drug trafficing, or get $20,000 for a felon with a firearm. Or in the Raleigh News & Observer you can get $500,000 bail for sexually molesting a 6 yr old. OR $200,000 for 2nd degree rape on a mentally incapacitated & physically helpless woman. That 5 yr old is not mentally able to understand what her mother set her up for and not physically able to defend herself. $51,000 bail? And she is not cooperating with finding her daughter either?

    First off i'm baffled the Fayettville police office would put this grinning nut of a woman out there to be a spokesperson...what is funny about this situation? If that were her child or maybe even not a child of color would she be grinning and laughing like a hyhenna?! The police dept is more of a disgrace and as guilty than the people who committed such horrific crimes to this little girl. This is all about a little publicity for them...they don't care about this little girl. Obviously they don't know how to handle such cases or else they would act like they have a little more class.

    Now I told you this story is crazy....Mario wasn't smiling in court because he's innocent. He's smiling because his girlfriend April was sitting there.What does she know because I don't know if I would be in court supporting a man that was seen on camera at a hotel with a missing 5year old at 6am. (Do April have kids)There's no way he was doing a good deed and he took Shaniya to a hotel miles away from home and stayed for an hour. Something is wrong with that. Also how was it known that they checked out in a hour if no one saw them exit. The police said tonight that Antionette was the one that told them that she saw her boyfriend Coe drive off with Shaniya but I thought they been saying she last saw the child at 5:30 on the couch.Shaniya is not in a good situation the way this is playing out. I hope they step there search up. This mom needs to talk now and I pray she is alive. McNeil didn't know he was going to be caught when he left that hotel so what has happened to Shaniya and why??? He thought no one would recognize him because she wan't reported missing yet---but thank GOD for the worker at the hotel.

    Joseph go back and re read out loud this news clip, they have question the boyfriend , they let him go and they arrested another man in the area where the child was seen at a hotel with this second guy in question , this child was taken out of her home in the early morning hours , not a bus stop. This little girl is only 5 years old. IMO , if I was the parent I would be in front of the news media asking for the safe return of my child also.

    This case is so confusing. I'm a mother and there's no way my child could be missing and I not be on every station you could turn to. What does this mother really know. Why would she be putting a 5year old on the couch at 5:30 am anyway. If Shaniya slept in a room with her mom and her boyfriend was home with his stepmother who did the mother need to be alone with in the bedroom that made her put the girl on the couch. If there is a tape of McNeil and the girl at the hotel why isn't there a tape of there exit. There has to be a tape of the parking lot. The police needs the community help and as long as they hold on to what they know it's another day of Shaniya's not coming home. POLICE----READ THIS---GIVE EVERYONE IN THAT HOME AND THE FATHER A LIE DETECTOR TEST. If Coe didn't know McNeil whose not to say the real father really doesn't. They could have met when they were dating sisters. This mom needs to talk now... And who is the sister dating now........Somebody in that home knows more...

A real mother who cares would be on every channel, at every station begging and pleading for her child's safe return, but she must have something to do with this situation. It's ridiculous when a woman puts a man before her child. If the boyfriend isn't part of this, I do believe the mother is. Hopefully, the child is safe somewhere, but this sounds like the Casey Anthony story. Hope this case has a better ending. What a sick world we live in!

    How terrible... look up Clarence Coe, the man that got released. There is an article about him being HIV positive, I hope he never raped that beautiful little girl... Her mother needs to wise up as to who she has around her daughter. I hope she comes back safe, and all her blood tests are negative. Single mothers... don't date men just released from prison.
