The train did not "kill the Man" The Man committed suicide. The man was trespassing on private property (All railroad property is private property). Trains can not swerve to miss someone like a car, they are on a track. And last but not least, trains cannot stop on a dime. Depending on the length of the train, it takes sometimes a mile or two to come to a complete stop. TRAINS DO NOT KILL PEOPLE -- people trespass and commit suicide.
